General information
The regulations describe the rules of shopping in Kendogu.pl. store. By placing an order you agree to the terms and information included in the regulations. Kendogu.pl internet store is the property of the JOTKA S.C. company, located in Warsaw 02-797, Al. KEN 49/204, regon 141502695, NIP 951-226-05-94. - 1. Kendogu.pl internet store sells goods via the Kendogu.pl website, in special circumstances the orders can also be placed by phone or by e-mail.
- 2. All products offered at Kendogu.pl are original, new, free of physical and legal defects.
- 3. All prices shown at Kendogu.pl are gross prices and include a 22% VAT. The store issues VAT invoices on request.
Orders
- 1. The binding price for the both parties is the price displayed in the product description in the moment of placing an order by the Client on the confirmation form.
- 2. Order acceptance takes place when the Client receives an e-mail from the store's staff confirming the order placement. Thereby a sale and purchase agreement between the Client and the Seller is concluded.
- 3. The Seller reserves the right to withdraw from order realization, in case the details given by the Client are incomplete, erroneous or arouse suspicion of invalidity.
- 4. The order will be carried out on the condition that the goods are available either in the store or at the store's supplier. In case a part of the goods included in the order is unavailable, the Client is informed about the status of his order, and decides on the manner of realization (partial realization, prolonging of the waiting time or cancelling the whole order). If the order cannot be realized, the store will return the payment to the Client.
- 5. The store reserves the right to change the prices of the goods offered, market new products, to launch and cancel promotional campaigns on the website, and to implement changes in them.
Shipping
- 1. Shipping time is given in the description of each item. It is the time that passes between placing an order and shipping the ordered goods from the store. If an order with different shipping times is placed, it is realized after completing the items for the whole order, i.e. after the longest of the given shipping times has passed. If the realization time unexpectedly becomes longer than the time given on our site, we contact the buyer via telephone or email to inform the Buyer about the delay and to confirm our will to realize the order. The shipping time does not include days off work.
- 2. The ordered goods are sent via Polish Post or a courier firm. The shipping cost is covered by the Client according to the current price list. In special cases mentioned in the item description, the goods may be sent free of charge, or can be collected personally by the buyer.
- 3. The delivery deadline is the sum of the shipping time and the delivery time.
- 4. The Client may choose a payment method from the following options:
- 1. Pay on delivery - paid to the postman or the courier;
- 2. By bank transfer, to the store's account.
- 5. In case the amount due for the order exceeds 900PLN, the Kendogu.pl store reserves the right to limit the payment options by demanding a prepayment equal to the whole or a part of the order value.
Complaints and returns- 1. In accordance with the "Act on Consumer Protection and responsibility for damage done by dangerous products", approved on 2/03/2002, the Client may resign from the goods ordered in our store within 10 days of receiving the goods, without giving any reason. A return is possible only if the product hasn't been used, and hasn't been damaged in any way (it applies to the packaging as well). The goods should be sent by the Buyer in the same state they have been bought in, i.e. in original packaging with the proof of purchase and instruction. The store guarantees refund of the item's value within 7 days of receiving the parcel. The money will be transferred to the account given by the Buyer. The delivery fee and return cost is covered by the Buyer and is not refunded. A complaint can be filed due to:
1. product's technical defect 2. a defect caused during the delivery process (this type of complaint will only be acknowledged when a complaint protocol has been drawn up with the delivering party, i.e. a postal worker or a courier). - 2. The right to withdraw from the agreement does not apply if the product is affected by mechanical damage of external origin. Before accepting a parcel from the post office or from a courier the Buyer should always check the packaging for damage done during the transport. In particular, attention should be directed at the state of the tape used to seal the parcel. In case the packaging bears any signs of damage, or if the tape is broken, the parcel shouldn't be accepted, a damage protocol should be drawn up in the presence of the courier and the store staff should be contacted as soon as possible. Checking the parcel at the time of delivery is necessary if a possible claim for the reason of damage or stealing is to be recognized. Any returns and parcels sent at the Kendogu.pl store's expense will not be accepted, unless some other arrangements have been previously made.
Final Provisions
- 1. When placing an order, the Client consciously gives his consent to process and use his personal data for the purpose of realizing the order. This data is not processed nor used for any other purpose.
- 2. Personal data placed in Kendogu.pl store's database is processed only for the store's needs, and is not made available to any other party. This data is gathered with due diligence and is respectively protected from unauthorized access, accordingly to the Personal Data Protection Act, approved on 29/08/1997 (Journal of Laws no 133, position 883, 1997). The Client has the right to inspect his data, to it's correction and has the right to demand from the store to stop using it. This data can be inspected and changed after logging in the store.
